Terms of Service

Welcome to Deuce. These Terms of Service ("Terms") govern your access to and use of the Deuce marketplace, located at deuce.global and any related applications, services, or platforms (collectively, the "Service"), operated by Highly Curated LLC, a Texas limited liability company ("Deuce," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. The Deuce Marketplace

Deuce is an online peer-to-peer marketplace that allows registered users ("Users") to list, buy, and sell new and pre-owned racquet sports equipment, including padel paddles, tennis racquets, pickleball paddles, apparel, and related accessories ("Items").

Deuce is not a party to any transaction between buyers and sellers. We provide the platform that enables transactions, payment processing through our third-party payment processor, and certain protective services described in these Terms. We do not own, sell, or take possession of Items listed on the Service except where expressly stated.

2. Eligibility

To use the Service, you must:

  • Be at least 18 years of age, or the age of majority in your jurisdiction, whichever is greater
  • Be a resident of the United States
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the Service under applicable law
  • Not have been previously suspended or removed from the Service

By using the Service, you represent and warrant that you meet all of these requirements.

3. Account Registration

To list Items for sale or purchase Items, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or engage in fraudulent or harmful activity.

4. Buying on Deuce

4.1 Placing Orders

When you place an order through the Service, you make a binding offer to purchase the Item from the seller at the listed price plus any applicable fees, taxes, and shipping costs. The transaction is complete when payment is captured and the seller accepts the order.

4.2 Pricing and Payment

All prices are listed in U.S. dollars. We collect payment at the time of order placement and hold the funds in escrow through our payment processor until the buyer confirms receipt of the Item or the protection period expires.

4.3 Buyer Protection

Deuce offers a 7-day buyer protection window starting on the day the Item is delivered. During this window, if the Item is materially different from the seller's description, you may file a return request as described in our Returns & Refunds Policy.

4.4 Buyer Responsibilities

As a buyer, you agree to:

  • Provide accurate shipping and contact information
  • Confirm receipt of Items in a timely manner
  • Use Items lawfully and at your own risk
  • Not file fraudulent return requests or chargebacks
  • Resolve disputes through Deuce's resolution process before initiating outside actions

5. Selling on Deuce

5.1 Listing Requirements

When you list an Item on Deuce, you represent and warrant that:

  • You are the lawful owner of the Item and have the right to sell it
  • The Item is authentic and not counterfeit, replica, or stolen
  • The Item description, photos, and condition grade are accurate and complete
  • The Item complies with our Prohibited Items Policy
  • You will ship the Item within 3 business days of order confirmation

5.2 Marketplace Fees

Deuce charges sellers a 12% marketplace fee on the final sale price of each successful transaction. This fee is automatically deducted from the sale proceeds before payout. Additional payment processing fees may apply as disclosed at the time of listing.

Deuce reserves the right to modify fee structures with 30 days' notice to active users.

5.3 Payouts

Seller payouts are processed through our third-party payment processor (currently Stripe Connect). Payouts are released 2-3 business days after the buyer confirms receipt of the Item or after the buyer protection period expires without a dispute.

To receive payouts, sellers must complete identity verification with our payment processor and link a valid U.S. bank account.

5.4 Shipping

Sellers must ship Items within 3 business days of order confirmation. Deuce provides prepaid shipping labels for U.S. domestic shipments. Sellers are responsible for proper packaging to prevent damage in transit.

If a seller fails to ship within 5 business days of order confirmation without justification, the order may be canceled and the buyer refunded in full. Repeated failures may result in account suspension.

5.5 Seller Responsibilities

As a seller, you agree to be bound by our Seller Agreement, which forms part of these Terms.

6. Prohibited Conduct

You agree not to:

  • List or sell counterfeit, stolen, or otherwise prohibited Items
  • Misrepresent the condition, authenticity, or characteristics of any Item
  • Manipulate prices, reviews, or marketplace dynamics
  • Communicate with other Users to circumvent the Deuce platform or fee structure
  • Use the Service to harass, threaten, or defraud other Users
  • Upload viruses, malware, or other harmful code
  • Scrape, copy, or reverse-engineer the Service
  • Create multiple accounts to evade restrictions or manipulate the marketplace
  • Use automated tools (bots, scrapers, etc.) without our express written permission
  • Violate any applicable local, state, federal, or international law

7. Intellectual Property

7.1 Deuce Content

The Service, including its design, code, logos, branding, text, and graphics, is owned by Deuce and protected by intellectual property laws. You may not copy, reproduce, modify, or create derivative works without our express written permission.

7.2 User Content

When you upload listings, photos, descriptions, reviews, or other content ("User Content") to the Service, you grant Deuce a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, display, reproduce, and distribute that content in connection with operating and promoting the Service.

You represent and warrant that you own or have the necessary rights to all User Content you upload, and that the content does not infringe any third-party rights.

7.3 DMCA

If you believe content on the Service infringes your intellectual property rights, please follow the procedures in our DMCA Policy.

8. Disputes Between Users

Deuce provides a dispute resolution process for transactions, as described in our Returns & Refunds Policy. For disputes outside of transactions (e.g., harassment, fraud), please contact support@deuce.global.

For all transaction disputes, Users agree to engage in Deuce's resolution process in good faith before pursuing outside legal action against the other party or against Deuce.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

DEUCE DOES NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • Items listed by sellers are authentic, described accurately, or fit for any purpose
  • Any User is who they claim to be
  • Transactions will be completed without dispute

DEUCE IS NOT A PARTY TO TRANSACTIONS BETWEEN USERS AND DOES NOT GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF ITEMS LISTED, OR THE ABILITY OF SELLERS TO SELL OR BUYERS TO PAY.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEUCE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

DEUCE'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DEUCE IN THE PAST 12 MONTHS, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you in full.

11. Indemnification

You agree to indemnify, defend, and hold harmless Deuce, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any dispute between you and another User
  • Items you list or sell on the Service

12. Termination

We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination:

  • Your right to access the Service ends immediately
  • Pending transactions will be completed or canceled at our discretion
  • Your User Content may be removed from the Service
  • These Terms will remain in effect with respect to your prior use

You may terminate your account at any time from your account settings under Privacy & Data → Delete Account. See Privacy Policy §5 for how deletion works in practice (we permanently remove personal identifiers but retain anonymized transaction records for tax and counterparty-protection reasons). Termination does not relieve you of payment obligations for completed or pending transactions.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

13.2 Arbitration Agreement

Any dispute arising from or related to these Terms or your use of the Service that cannot be resolved through Deuce's standard resolution process shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will be conducted in Harris County, Texas, or by video conference, at the claimant's election.

13.3 Class Action Waiver

You agree to bring any claims against Deuce only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

13.4 Exceptions

Notwithstanding the above, either party may bring an action in small claims court for any qualifying dispute, or seek injunctive relief in court for intellectual property violations.

13.5 Opt-Out

You may opt out of the arbitration agreement by sending written notice to support@deuce.global within 30 days of first agreeing to these Terms.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced through the Service or by email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with the Privacy Policy, Seller Agreement, Returns Policy, and other policies referenced herein, constitute the entire agreement between you and Deuce regarding the Service.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

15.3 No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

15.4 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms freely.

15.5 Notices

Notices to Deuce should be sent to support@deuce.global. We may provide notices to you through the Service, by email, or by other reasonable means.
